Por los razonamientos anteriormente expuestos, este JUZGADO SUPERIOR SEXTO EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la ley, declara: PRIMERO: PARCIALMENTE CON LUGAR la apelación interpuesta por la abogado LILIAM RIVERA FERNANDEZ, actuando en su carácter de apoderada judicial de la parte actora ciudadana ROSA ARICELA GARCIA PAREDES, contra el fallo de fecha 07 de abril del año dos mil tres (2003), proferido por el JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS. SEGUNDO: CON LUGAR la demanda de SIMULACIÓN incoada por la ciudadana ROSA ARICELA GARCÍA PAREDES, contra el hoy fallecido, ciudadano GUILLERMO EDUARDO GARCIA COLL, la sociedad mercantil INMOBILIARIA GARTOCA C.A. y el ciudadano DANIEL GARCIA TORRES, suficientemente identificados .....
