Por los razonamientos anteriormente expuestos, este JUZGADO SUPERIOR SEXTO EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, administrando justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la ley, declara: PRIMERO: CON LUGAR la apelación interpuesta por la abogado HERDAZAY BORGES, actuando en su carácter de apoderada judicial de los ciudadanos HERNAN BORGES Y SANTA RAMONA BORGES parte actora en el presente juicio, contra el fallo de fecha 26 de abril del año dos mil siete (2007), proferido por el JUZGADO OCTAVO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y DEL TRÁNSITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS.
