Por las razones de hecho y de derecho anteriormente expuestas, este JUZGADO NOVENO DE PRIMERA INSTANCIA DE JUICIO DEL CIRCUITO JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, administrando Justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, declara: PRIMERO: SIN LUGAR la demanda por Cobro de diferencia de Prestaciones Sociales incoada por el SINDICATO DE OBREROS Y MARINOS DEL INSTITUTO NACIONAL DE CANALIZACIONES (SOMINC), y los ciudadanos IRIARTE DOUGLAS, NUÑEZ ANGEL, ESPINA SAVAS, ESCARAY HERIBERTO, GONZALEZ ASDRUBAL, TORRES NELSON, GUERRA HUGO, PETIT ANGEL, QUINTERO EUDO, OQUENDO NILO, BRACHO HEBERTO, BRACHO IVAN, MUÑOZ RAFAEL, CHACIN MANUEL, MOLINA FREDDY, MEDINA ADINSON, MOLERO FERNANDO, INFANTE NESTOR, IRIARTE JOAN, contra el INSTITUTO NACIONAL DE CANALIZACIONES, plenamente identificados en autos. SEGUNDO: No hay condenatoria en costas de conformidad con lo dispuesto en el artículo 64 de la Ley Orgánica Procesal del Trabajo.
