Resumen: Por todas las consideraciones anteriormente expuestas, este Tribunal Tercero (3°) Superior del Trabajo del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, administrando justicia en nombre de la República Bolivariana de Venezuela y por expresa autoridad de la ley, DECLARA: PRIMERO: SIN LUGAR la apelación formulada por la parte ACTORA, SEGUNDO: SE CONFIRMA EL FALLO RECURRIDO DICTADA POR EL JUZGADO SÉPTIMO (7°) DE PRIMERA INSTANCIA DE JUICIO DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, EN FECHA DOS (02) DE MARZO DE 2012. TERCERO: SE CONDENA EN COSTAS A LA PARTE DEMANDADA RECURRENTE DE CONFORMIDAD CON LO ESTABLECDIO EN EL ARTÍCULO 60 DE LA LEY ORGÁNICA PROCESAL DEL TRABAJO.
